Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and TUBROTHERS LLC, doing business as TuzChat ("TuzChat," "we," "us," or "our") governing your access to and use of the TuzChat website, application, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 16 years old to use TuzChat. By registering, you represent that you meet this requirement and that all information you provide (name, email) is accurate.

2. Your Account

  • You're responsible for keeping your password confidential and for all activity under your account.
  • Email verification is required before you can log in.
  • You can request a password reset at any time via the "Forgot password?" link; reset links expire after 1 hour and can only be used once.
  • Notify us immediately at feedback@tuzchat.com if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to use TuzChat to:

  • Post or transmit content that is illegal, harassing, hateful, defamatory, obscene, or infringes someone else's rights (including intellectual property and privacy rights).
  • Use abusive, threatening, or offensive language toward other users, community members, or our staff, in posts, replies, communities, or comments.
  • Impersonate any person or entity, or misrepresent your affiliation with one.
  • Spam, scrape, or attempt to circumvent rate limits or access controls.
  • Attempt to gain unauthorized access to other accounts, the underlying systems, or data you're not authorized to see.
  • Use the Service to generate or distribute content that violates applicable law, including content involving the exploitation of minors, which we report to the relevant authorities.
  • Use automated means (bots, scrapers) to access the Service outside of any API we may officially provide.

Violating any of the above — including the use of abusive language — may result in content removal, a warning, temporary suspension, or permanent termination of your account, at our discretion, with or without notice.

4. The Feed, Communities, Posts, and Comments

TuzChat lets you post short updates to a public feed, like and reply to other people's posts, and follow other users, as well as post and comment in public communities. Content you post is visible to other users and, depending on where you post it, may be publicly accessible. Don't post anything you're not comfortable being public. You retain ownership of the content you post, but you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as necessary to operate the Service. We may remove posts, replies, or comments that violate these Terms or applicable law. Administrators have the ability to edit or delete content and manage user access as part of moderating the platform.

5. Rate Limits

To keep the Service available for everyone, we apply rate limits to API requests. Repeated attempts to exceed these limits may result in temporary or permanent restriction of your access.

6. Intellectual Property

The TuzChat name, logo, and the Service's underlying software are owned by us or our licensors and are protected by intellectual property law. These Terms don't grant you any rights to our trademarks or branding.

7. Disclaimers

YOUR ACCESS TO AND USE OF THE SERVICE, AND ANY CONTENT ON IT, IS AT YOUR OWN RISK. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE.

Content posted by others.TuzChat is a platform for user-generated content. We do not create, verify, endorse, or take responsibility for posts, comments, replies, or messages submitted by users, and we are not responsible or liable for the actions or conduct of any user or third party, or for any content they share — including content that is offensive, inaccurate, defamatory, or otherwise objectionable. Views expressed by users are their own and do not reflect our views.

Third-party news content.Some content on TuzChat (including in the "World News" feed and similar features) is imported from third-party news providers and publishers. We don't independently verify, edit, or endorse this content, and we're not responsible for its accuracy, completeness, or timeliness. Any links to third-party sites are provided for convenience only; we don't control and aren't responsible for the content, policies, or practices of any third-party site.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUZCHAT AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY CONTENT ON IT, OR ANY CONDUCT OF ANY USER OR THIRD PARTY ON THE SERVICE — REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, WARRANTY, OR OTHERWISE) AND EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED one hundred US dollars ($100), or the amount you paid us in the past 12 months, whichever is greater. IN OTHER WORDS: WE ARE NOT RESPONSIBLE FOR ANYTHING THAT HAPPENS AS A RESULT OF YOUR USE OF THE SERVICE, EXCEPT AS REQUIRED BY LAW. SOME JURISDICTIONS DON'T ALLOW THE LIMITATIONS ABOVE, SO SOME OF THEM MAY NOT APPLY TO YOU.

8a. Modifying or Discontinuing the Service

We may change, suspend, or discontinue the Service, or any part or feature of it (including the news feed, communities, or any other feature), at any time, with or without notice, and without liability to you. We may also set or change limits on storage, message size, or usage at our sole discretion.

9. Termination

You can stop using the Service and delete your account at any time by contacting us at feedback@tuzchat.com.

We reserve the right to suspend or terminate any account, or restrict access to the Service, at our sole discretion, at any time, with or without cause or notice — including, but not limited to, violations of these Terms (such as the use of abusive language described in Section 3). We may also discontinue the Service entirely at our discretion.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where required by law, notify you by email. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Maryland, USA.
